The insured that due to work injuries or occupational diseases loses work ability shall be entitled to the following benefits:
A. Benefit for temporary incapacity due to work injury or occupational disease;
B. Benefit for permanent disability due to work injury or occupational disease;
C. Benefit for permanent partial disability due to work injury or occupational disease;
D. Benefit for permanent lower scale incapacity due to work injury or occupational disease.
a) Benefits for temporary incapacity due to work injuries or occupational diseases
1. Legal basis:
a) Chapter IV, Articles 43, 44, 45, 46, 47, 48, 49, 50, 51, 52, of Law no 7703, date 11.05.1993 “On Social Insurance in the Republic of Albania”, amended;
b) Decision no 788, date 14.12.2005 “On definition of injury at work and injury due to work”;
c) Decision no 396, dated 28.06.2007 “On definition of occupational diseases;
d) Regulation no 37, of SII, date 23.12.2004 “On determination, administration and payment of short-term benefits;
e) Regulation no 494, of SII, date 05.10.1993 “On issuance of sickness-leave certificates (for temporary incapacity to work);
f) Instruction no 1, of SII, date 24.09.1993 “On criteria for determination of work ability of the disabled due to work injuries”;
g) Regulation no 7, of SII, dated 16.06.1994 “On complementary medical care and rehabilitation in case of small injuries and reasonable indemnities”
2. Eligibility conditions:
a) Benefit for temporary incapacity due to work injury or occupational disease shall be granted only to employed persons;
b) Respective medical certificate is issued by the hospital or Medical and Legal Commission, lasting up to 12 months.
3. Documentation:
a) Medical certificate for injury at work;
b) Standard form for injury at work, to be filled in by the entity and confirmed by State Labor Inspectorate;
c) Assessment base form of last three years of work. (this document is to be filled in by finance sector of the entity);
d) Entity’s finance sector, based on the documents under point “a”, shall complete the standard payroll form for short term benefits and send it to the respective LSIA;
e) After checking and verifying documents presented, LSIA shall deliver payments to the personal account of the beneficiary or to entity’s account.
4. Benefit amount:
a) 100% of average daily assessment base of the last three calendar years;
b) This benefit amount shall last up to 12 month period.
